I just checked that Nebraska is now processing cases from August 2007 for I 140 applications. Do these also indicate China and India?
My pd for I 140 is in July, and I am from india. Should I be able to make a query since the dates have gone past my PD?
    thanks for any info....

    Hi,

I am currently on H1b and had recently filed papers for transfer from employer A to employer B. I have got the email from USCIS that my case has been approved and that documents will be delivered soon.

My H1b transfer has been accepted for 01/01/2010. My date of joining the new job is 01/04/2010. My original H1b with company A is still valid till Oct 2009.

Since I have to give my old employer a two weeks notice to resign. If I give my notice around 12/21/2009 (notice period of leaving by 01/04/2010) and my employer relieves (terminates) me immediately will I be out of status at any time?

Also, My green card process is going to start soon. Is it going to affect me as I am worried that I might be out of visa status from 12/21/2009 to 01/01/2010.

Please suggest. I need to make a decision in few day.

    Would greatly appreciate a response.
    Thanks,

    All,

    Here is my situation.

    - I have an approved I140 by my current employer and waiting for 485 to become current.
    - I am in the 7th year of my H1 with current validity till mid 2011.

In case I lose job with the current employer, and the employer withdraws H1-B and I140, what are the options I have?

Can I transfer H1 or apply for H1-B with another employer? How much grace period I have to leave the country?

Appreciate any help from you guys.

My PERM case has been pending for almost 15 months (under audit for 12 months). I asked my attorney about this enquiry thing that you can file to DOL after pending for 15 months (according to this thread (http://immigrationvoice.org/forum/showthread.php?t=21183&page=2)). Her response is that she has been sending requests about case status to the DOL on a regular basis.

Can anyone who's familiar with the matter tell me what's this enquiry is about? Is it just a regular status check or a more formal and serious matter that DOL has to assign a freaking living human to look at your case to reply?

    Hi,

Based on what I know, the medical exam has to be less than 1 year old on the date of I-485 application submission. However, I have seen different opinions on this forum. Some state that the exam date cannot be more than 30 days before I-485 submission, because the HIV test and syphyllis test (sorry if not typed correctly) are valid for 30 days only. Could anyone clarify this, please?

    Thanks in advance.

    Bogdan

As Rodney King famously remarked, "Why can't we all get along?" As Democrats and Republicans in Congress have spent the past year beating each other up regarding the health care bill, do we want the same thing to happen with immigration this year? At the moment, President Obama cannot even find two Republican senators out of 40 to support Comprehensive Immigration Reform. And anyone who thinks that all Democrats are united in support of CIR must be drinking the Kool-Aid. But does this mean that immigration reform is DOA in 2010? Not necessarily. There are individual pieces of immigration legislation...

    Hi:

This is complicated. IF you are a citizen or if your wife has any US.S. citizen parents, she can file I-601 waiver application. But if your wife made unlawful entry , departed the U.S and reentered the U.S, then she is subjected to a permanent bar, and she cannot apply for a waiver for a period of 10 yrs. You need to consult a good attorney.

    Hi,

My spouse was on H1, the applied for H4 which was approved but he start date was incorrect, so an I102 was applied to get the I-94 corrected , we got the dates incorrect again so the lawyer applied for correct of dates again (October 2010). This whole thing has been going on for an year now.

In the mean time, we had a family emergency and my wife had to go to India , She went on a valid AdvanceParole. ( We have a pending 485 , so got an AP also)

Today we received a mail from USCIS, asking her to attend an interview regarding this I-94 replacement.

. She is not in US
. She submitted all the I94 cards she had at the Aiport

    1. Will she have any problem coming back. She was always on Status. NO issues there
    2. Is there any way to postpone the interview ?
    3. Does it affect my I-485
    4. What is the best course of action

    Hello All,

I will be appearing for L1 individual visa extension in chennai in a few days from now.

One the questions that would be asked by the VO would be "where and who do you work for". The second part is easy since i work for the petitioning employer rendering my services for their client. However for the first part of the question what appropriate answer can be given?

Can i mention the client name location in US since that is where i currently work although i am controlled by the petitioning employer. I would not be working from the petitioning employer work location in US. I believe the L1 Visa reform act of June 2005, tells that you can work from offsite location provided you are controlled/managed by petitioner.

Please advise as it would help me in responding with correct answer. Thanks.

Breakdown in Relations in the Senate Hobbles Its Ability to Get Things Done (http://www.nytimes.com/2007/07/20/washington/20cong.html?_r=1&oref=slogin) By CARL HULSE (http://www.nytimes.com/gst/emailus.html) New York Times, July 20, 2007

WASHINGTON, July 19 Arlen Specter is a senior United States senator who expects to be allowed his say on the Senate floor. So he bristled when Senator Harry Reid, the majority leader, brusquely cut him off at the end of the Iraq debate.

The leadership is setting a dictatorial tone, Mr. Specter, Republican of Pennsylvania, said Thursday, still furious over his treatment the day before. Senators didnt get here to be pushed around.

It may seem small-minded to bicker over a few words at the end of a 24-hour debate. But the clash between the two veteran senators is evidence of a larger breakdown in relations in the Senate, a deterioration in cooperation that is hobbling the Senates ability to get things done. The situation is not likely to improve with a presidential election on the horizon.

As the cots were rolled away and lawmakers left for a decent nights rest after the around-the-clock debate that ended like others this year in stalemate, lawmakers of both parties said they had rarely seen the tone so poisonous and the willingness to work together on the floor at such a low ebb.

The last vestiges of courtesy seem to be going out the window, said Senator Trent Lott, the Mississippi Republican who has served as majority and minority leader. Every time I think the Senate Republican or Democrat has gone to a point where you cant go any lower, we go lower.

It is hardly startling that members of the two parties do not see eye to eye. And the spirit of bipartisanship in the Senate always rises and falls depending on the subject and the election calendar. But seven months into the new Democratic regime, the environment seems unusually hostile. Occasionally, senators do, too, as exhibited in a Sunday television exchange between Senators Jim Webb, Democrat of Virginia, and Lindsey Graham, Republican of South Carolina, that looked for a moment as if it might turn physical as the two men argued about the war in Iraq.

The angry attacks nearly spiraled out of control Thursday night as the two parties lobbed political bombs at each other during the windup of work on an otherwise popular higher education measure.

After Republicans brought forward proposals intended to embarrass Democrats on terror detainees and union elections, Democrats countered with a resolution urging President Bush not to pardon I. Lewis Libby Jr., a former top White House aide. Republicans struck back with a resolution deploring the pardons issued by President Bill Clinton.

The floor descended into chaos as members of the two parties glowered at one another across the aisle. Evidently recognizing they had gone too far, party leaders pulled back and agreed to try to finish the education bill as Democrats struck their Libby proposal from the record.

Hard feelings have consequences. Without agreements between the leaders of the opposing parties, the Senate has been plunged into a procedural knife fight, with Democrats forced to scramble to find 60 votes not just on contentious issues like an Iraq withdrawal plan, but on once-routine matters like motions to proceed to a spending bill.

The feuding has spilled into subjects that would seem to hold the potential for common ground, like antiterror legislation and lobbying reform, and will doubtless tie up other measures to come.

Democrats contend that Republicans have embarked on a strategy of delay, using Senate rules to chew up scarce legislative time and deny Democrats any accomplishments. Republicans complain that Democrats are trying to jam through objectionable bills and are mainly interested in building a political case for 2008. The relationship between Mr. Reid and his Republican counterpart, Senator Mitch McConnell of Kentucky, has cooled after it was initially thought the two Senate tacticians would be able to do business.

Senator Edward M. Kennedy, the Massachusetts Democrat who has been in the Senate for more than four decades, said he was not sure bipartisanship was at an all-time low, but acknowledged things were tense.

The fact the Senate is so evenly divided makes big causes out of smaller events, Mr. Kennedy said.

Besides the narrow 51-49 majority Democrats enjoy, lawmakers and others attribute what senators deplore as a lack of comity to various reasons, including the emotions surrounding the Iraq war debate, a Republican payback for Democratic stalling in recent years and pure political maneuvering in a hot-house environment.

Mr. Reid on Thursday blamed Republican ideology, saying the Senates conservative contingent was unwilling to swallow legislation sought by most Americans.

Republicans in the Senate do not represent mainstream Republicans around the country, he said.

Members of both houses have been contending for years that the sort of personal interaction that can lead lawmakers to overcome partisan differences has been on the decline, leaving Congress polarized.

But Mr. Kennedy, Mr. Specter and others say they find that committee leaders still tend to be able to work together. And a bipartisan group of senior lawmakers put together the Senates immigration proposal, though it went down in flames to the broader political divide in Congress.

Senator Carl Levin of Michigan, the chairman of the Armed Services Committee who has been in the heat of the battle over the Iraq legislation, said he did not believe feelings were frayed beyond repair.

The Senate is a unique place where wills are tested, and this was a very important issue that people have very strong feelings on, he said, referring to the Iraq debate. Instead of fighting over it physically, there are battles that are fought on the floor of the Senate. But these are important disagreements and they should be aired.

Isnt that what we are here for?

    Hi,

I had a question regarding employment in OPT STEM extension. I recently(one week back) got a job and joined as a independent contractor(adding me as a vendor to company and at the time of joining they asked me to fill W-9 form) in company. I was joined first and thought of ask them to enroll in E-verify later.

But couple of days back when I ask the HR for company to enroll in E-Verify in order to update to school officials. HR refuses to enroll because as I was working as an independent contractor and not coming under their payroll.

Regarding how do I get paid? They will pay me bi-weekly. But I need to rise the invoice and submit time sheet and give it to them so that they will pay me a payable check.

And even I got approved OPT STEM extension couple of days back which I was applied through my previous employer.

Is there a way to come out of this situation?

Even thinking of adding a consulting firm layer in between the company and me but I don't want to do that. Please help me out.

I am traveling to India after long time. The airline reservation requires me to provide my green card number. Can anyone tell me what that is? Is it A# number?

I tried entering the 9 digits of A# number on the airline website without a success, what is a right syntax?
AXXX-XXX-XXX or XXXXXXXXX without using -

I dont want to submit wrong information.

Also, is it possible to provide this information at Check-In and not to worry about it now?
If anyone has done this before then let me know, any help is appreciated.
