Please correct me if i am wrong.
WH-4 Time line is within a year, means if betrayel/non payment happened with in a year from the date of reporting it will be investigated, and YOU CAN FILE WH-4 FROM OUTSIDE OF US ALSO, if your consultant company sent you back with fake commitments.
But not sure if your h1 still have time, after DOL complain, you can transfer it or not??
Anyone has any idea???

Hi,
I have my EAD/AP. I'm EB3-I.
I paid my attorney for the 485 processing. But the law firm works for my company.
They have been good so far (law firm) but I guess it would be better for me to first change the attorney If I plan to file AC21.
I would appreciate it if someone can suggest me good attorney . What would be the fee I can be looking at to pay the new attorney at this point of my GC. processing( With EAD/AP ..renewal also taken care.)
(If it is not appropriate to mention the figure I would appreciate it if someone can just give me a range/ballpark figure)

My I-140 got approved and priority date from EB3 got ported to EB2. I read in one of the forum threads that USCIS system would automatically identify that application is current and appropriate action will be taken. Also, I read about initiating interfile process of existing EB2 I-140 (current) with Pending I-485 application (under EB3). I am not sure whether I should wait few weeks before initiating interfile process.
I have given my biometrics in 2007 while filing I-485. Will USCIS send appointment for Biometrics again ?

I have noticed that they have been given instructions not to give any information now due to the volume of calls HOWEVER if you keep trying you might get one person who is kind enough to answer your questions..
I tried 3 times (called with few days in between) and two time I faced pretty short replies with no help. But third time I got a very nice person who gave me more info. Among the few things I learnt were that they are still doing cases as of Aug 2006 and few random cases are being worked on dates after that. Details about I-140 will not be told unless you are the employer or the attorney. But you can ask about the status of your name check.

I mean, will it matter if someone applied for 485 on July 30th or August 17th, other than trying for an EAD and AP earlier ?
2. Is there a benefit of applying early in the timeframe, in getting an approved 485 ?
Please respond at your convenience.

Hi, I have approved H1b through company "NewCompany" but my GC sponsoring company "GCcompany" is planning to cancel my APPROVED 140. Again, I know USCIS will do inted to deny and Yes, I have filed for 485 + it's been 180+ days but I guess the most important question of all is:-
"Will this affect my H1B status?' Since the approval for new 3 year (extension) was based on my 140 and now this thing is under jeopardy. If I use EAD, my wife will no longer be H4 and thats a different problem- Gosh when is thind going to end?"

I am end of my 6th year of H1B and my current employer filed H1B extension using my approved I-140 (and I don't have EAD). However my employer took the advantage of my immigration status and reduced my salary drastically . I am planning to change my employer after I receive my H1B extension. Now I have following questions
1. If I accept new job with other employer and transfer my H1B to new employer, by what time (months, years..) my new employer has to file PERM to continue my GC process?
2. What if my current employer cancels my I-140 when I moved to new employer? Still can I use that I-140 to port my priority date to new employer?
I can plan my future employment based on your response. Thanks for your time.

My cousin from India has a BCOM degree and he is filing for a H1 B visa.
He just heard from his lawyer 2 days ago that his credit evaluation was needed and he had to get experience letters for atleast 3 years of work ex.
He gave it to his lawyer and now they tell him that they will submit his application without the evaluation! They said that once an inquiry comes if it even does then we will submit the evaluation.
Is that ok??? or should he be submitting the evaluation with the application. I am concerned but I guess it too late now.

My I-140 was denied by TSC early last year. We sent in an MTR/Appeal on the denial. The case was sent over by the TSC to AAO. We received an RFE from the AAO on the appeal a couple of months back. We responded back to the RFE within the required time frame.
My attorney just informed me this week that the case has been transferred back to the USCIS from the AAO. Can anyone please tell me if this means that my case has been approved or denied? Also how long can the USCIS sit on it before adjudicating? I'm assuming that the AAO has passed a decision, thats why they have sent it back to USCIS....
PLEASE HELP!!!

Also how long can the USCIS sit on it before adjudicating? I'm assuming that the AAO has passed a decision, thats why they have sent it back to USCIS....
