Guys, I need ur suggestion and experiences on my typical situation
I am in the process of going full time with my client.
I have my I-485 Filed in July 2007 & have EAD & AP
I am not in a position to use EAD as I got married after I filed for I-485. I have to stay on H1B to maintain my wife's H4 status.
my Client's Attorney is filing for H1B transfer and is suggesting that I can use EAD to start working as soon as he files for H1B transfer.
My understanding is I will loose H1 status if I use EAD, hence H4 will be invalid.
Was anybody in a similar situation ?
I don't want to take a risk by using EAD and my wife loosing H4 status.
Please advice

I have one white I 94 which you get at the port of last entry and three H1 I 94 (one original H1 I 94, two extention I 94s). The latest I 94 goes till 2010. Should I surrender all four I 94s or just the expired ones or just the white one.

What will be the status of pending H1B extension case if EAD/AP is used on reentry to US. If the case is approved after rentry, is it possible to change status to H1?

Hi,
I am GC holder & right now I am living out side USA with my husbad whom I am married for more than 8 yrs. I have 2 kids, they are US citizen. I visit my parents (US Citizen) every year to US for couple of months & come back. In past my husband tried for US visitor visa few times but he was denied. Is there any way I can apply for my husnad a non immigrant VISA from US for a visit? As we would not like to migrate to US but just to visit there. Is there any way or I have to apply for him immigrant visa only & wait for 5-7 yrs.?
Please guide.

Hello Everyone,
My dates are current last month. I added my wife couple weeks back [I couldnt add her earlier as i was not married then]. I got her receipt notices and also fingerprinting. My question is :
is there a way to say that she is linked to my application ?
becuase when I call USCIS, they say: This is separate application and they cant say if it is linked to primary or not.
--> Does receiving receipt notices mean that they accepted her application and linked to primary ?
--> does Fingerprinting appointment means that they accepted her application.
My concern is if my GC is approved and if she is not linked, it would be a problem,I guess.
So, please advise me as to how would i know if she is linked to my application?

This is related to the experience letter and PERM.
I have been working with my current employer for last 3 years in software engineering role. Now I'm planning to move to program management role and planning to apply PERM from this new role.
1. To get experience letter for PERM, can I use the experience gained in my current company. What are the chances of AUDIT if I do so?
2. With my previous employer (3 yrs back) I worked in software and consulting role. Does this experience suffice for my PERM in program management role...Is it something the lawyer has to worry and not me..

i was in same situation. my wife's AP was approved and mine not, before leaving US, so i went for h1 stamping but, my wife didnt. on return, i entered on H1 and she entered on AP.
SFO port. they asked her to go to secondary inspection room, had to wait for 1/2 hr. they called her name, no questions asked, gave her docs back. we both were in.
this was back in Feb'09. i work directly for F100, popular company.

I have my L1 Visa from X Company and I traveled to US for 2 months.
I also have my H1B Visa from Y Company stamped in my passport.
I am planning to enter US with my L1 Visa and then change my status to H1B after a month.
1) If I get a job, can I change my status from L1 to H1 within a month? Is there any minimum period to work on L1 for change of status?
2) Do I need the consent of my X Company for having the change of status to H1B done?
3) What documents are required for the change of status? I will not have my pay stubs during my stay on L1 status, as I will be paid just the per diam.
4) If I enter US with my H1B Visa and if I am deported to my Home country (because I just have 7 months) validity of my H1B (or) due to employer-employee relationship issue), can I still use my L1 Visa of my X Company to revisit US?

No he doesn't have pending GC status.His wife is on 4th year of H1 and she already got EAD.But her priority date is not current (Sept 06)to add him to her GC status immediately.

They can pay you in anything they like for immigration purposes. US immigration doesn't care what you get paid when you're outside the US.

I got my H1 approved in Oct 2004 and it was from Oct 2004 - Oct 2007. I used only 6 months of H1 and later went on TN (work visa for Canadian citizens) and remained in US working on TN for 4 years. I was in US all these years. Now even the earlier H1 approval duration is over, Can I apply for H1 with another employer using the old 2004 H1 quota cap or it has to be under new 2009 cap? Thanks in advance.

lost_angeles: she can travel outside US, as she has a valid H4 stamp. There is no need to wait for AP, I see no issues.
