Dear members,
I am working in India. I have an L1 petition which is valid from sep 2004 through sep 2007 from my company. When I went for visa stamping in 2004 the visa officer gave me a visa valid from sep 2004 through Nov 2005. This meant that I could enter US only in the first year of my petition but continue to stay legally in US on an I-94 through Sep 2007. As of today, I may have to leave for US in March 2007 on this L1 and my question is that if I go for a renewal at the US consulate will they renew my visa for a petition that will expire in Sep 2007. Considering that there are only 7 valid months left on the petition.

Hi guys,
I got as well the unlucky audit like almost 80% of the people filing for a PERM.
My L1 visa is expiring on May 14th and the PERM audit reply was on Jan 28th and based on the current cases pending, I will hearing back from Atlanta sometimes between July-August.
I also applied for the H1-B and get approved but it is starting on Oct-1st,2008
1.- Can I stay "out-of-status" based on the INA 245 that "allow us to stay up to 180 days because change of status in process"?
2.- This changes of status process is valid only when you file the I-485 or for anyone already starting GC process like PERM in process?
3.- If I need to come back to my country and get the H1-B stamped, Do I loose the current PERM even if it get aproved or can I use the same PERM once aproved and apply for I-140/I-1485 concurrently (because EB-2 category) no matter I 'll have a different Visa H1-B instead of L1-B stated in the PERM?

My Original PERM labor certificate was lost in mail so we filed my I-140 without the PERM LC and asked USCIS to obtain the certificate from DoL. USCIS got the labour certificate from DoL and sent the original LC to us as an RFE to get my employer's and my signature on the perm certificate. My employer by mistake signed the labor certificate where I was supposed to sign :(. We have now covered his sign with white paint and I would be signing at correct place and sending back to USCIS. Do you think any white ink or over writing on original PERM certificate would matter in adjudication of my 140?

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. Hi,
I applied for my wife's AP online & while entering her SSN there was a typo (wrong digit entered).
What will happnen to the application? will I get RFE? or should I send letter addressing the issue with copy of SSN card along with copy of receipt?
Any help is appriciated.

For how many years does the employer have to guarantee that it has funding to pay my salary? Or how does this thing work out. My employer has 300+ employees.
Any other requirements from the employer?

The employer has to be big enough (300+ is a big company) or if small (such as less than 15), it has to show company's return and sometimes business in hand.

I got my EAD last October (filed for my I-485 on July 02, '07) but did not apply for my AP then;
Now I need to apply for my EAD renewal and am also thinking of getting an AP. Do I need to get an AP for the current year (that is for the time period from Oct '07 to Oc 08) and then apply for AP extension or can I directly apply for AP for Oct '08 to Oct '09?
the second option will save me money and so for me that is the preferred one :D
any information on this is much appreciated,
